The Relationship
By participating in this Program, you agree to act as an Independent Contractor. This Agreement does not establish a partnership, joint venture, agency, franchise, or employment relationship between you and Partastar AU Pty Ltd. You are solely responsible for your own business activities and taxes.
Enrollment & Acceptance
All applications are subject to a formal review process by our team. Partastar AU reserves the right to request additional information regarding your promotional methods or audience demographics. Acceptance into the Program is at our sole discretion. If your application is not approved within thirty (30) days, it shall be considered declined. Upon acceptance, the terms of this Agreement become immediately effective.
Compliance & Transparency
Account Integrity: You must provide and maintain accurate contact, payment, and tax information (including ABN where applicable).
Mandatory Disclosure (ACCC Standards): To comply with Australian Consumer Law and ACCC guidelines, you MUST clearly and prominently disclose your affiliate relationship. All promotional content must include clear identifiers such as #Ad, #Advert, or #PaidPartnership.
Prohibition on Self-Referral: The Program is intended for referring unique third-party customers. Commissions will not be paid on orders placed using your own affiliate link or associated IP addresses.
Promotional Guidelines & Restrictions
To protect our brand integrity, please adhere to the following:
- Anti-Spam: Unauthorized or unsolicited commercial emails and mass forum postings are strictly prohibited.
- Paid Search Policy: Bidding on “Partastar AU” branded keywords or variations on search engines (Google, Bing, etc.) is not permitted without prior written consent.
- Truth in Advertising: All claims regarding our products must be substantiated. Avoid misleading conduct or unauthorized “Price Match” or “Lowest Price” guarantees.
Tracking & Cookie Policy
Cookie Duration: We utilize a 30-day tracking cookie. If a referred customer completes a purchase within this window, the sale will be attributed to your account.
Last-Click Attribution: Our system credits the most recent affiliate link clicked by the customer prior to the purchase.
Technical Disclaimer: We are not responsible for tracking failures resulting from user-deleted cookies or browser-based privacy settings.
Commission Structure & Payments
We reward our partners through a tiered performance-based structure.
Tiered Rewards: Your commission rate is determined by your performance. As your referral volume increases, you will be eligible for higher-tier commission rates.
Calculation: Commissions are calculated on the Net Sale Amount (Total price minus GST, shipping fees, and any applied discounts).
Payment Schedule: To account for the standard Australian return period and consumer statutory guarantees, there is a 45-day locking period for all commissions. Payments are released via PayPal, Stripe, or Bank Transfer once the minimum threshold is met.
Termination of Agreement
Partastar AU reserves the sole discretion to determine the validity of any referral, the eligibility of commissions, and the interpretation of these terms. In the event of any dispute regarding the program, the decision made by Partastar AU shall be final and binding.
Governing Law
This Agreement is governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Victoria.
